By accessing or using RealtyAssistAI ("the Service") at realtyassistai.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and GetBotPacks LLC ("we," "us," or "our").

1. Eligibility

You must be at least 18 years of age to use this Service. RealtyAssistAI is designed for licensed real estate professionals or those working under the supervision of a licensed professional. By using the Service, you represent that you are qualified to evaluate and apply AI-generated content in a professional real estate context.

2. What RealtyAssistAI Is — and Is Not

RealtyAssistAI provides AI-powered tools to help licensed real estate agents with productivity tasks including: lead qualification, market analysis, property reports, listing copy, client communications, checklists, offer summaries, follow-up sequences, social media content, mortgage estimates, neighborhood data, and negotiation strategy assistance.

4. Neighborhood Data — Accuracy and Limitations

The Neighborhood Health Card and related data features draw from third-party public sources including:

• FBI Uniform Crime Report (UCR): Annual data, city-level aggregates. Not address-specific. Crime patterns change over time.
• NCES (National Center for Education Statistics): Public school district data. School quality is subjective and multi-dimensional.
• FEMA Flood Map Service: Flood zone designations may not reflect recent remapping or local conditions.
• First Street Foundation / Climate Data: Risk models based on projections — not guarantees of future conditions.
• Walk Score / Google APIs: Third-party services subject to their own accuracy limitations.

We provide this data as a starting point for conversation, not as a definitive assessment. Always direct clients to consult primary sources (county assessors, FEMA, local authorities) for decisions that depend on this data, particularly flood insurance requirements.

5. Negotiation Coach — Specific Disclaimer

The Negotiation Coach tool provides AI-generated tactical suggestions for real estate negotiations. This content:

• Is not legal advice and does not create an attorney-client or fiduciary relationship
• Is based solely on information you provide — incomplete inputs produce incomplete output
• Cannot account for local market nuance, relationship dynamics, or undisclosed information
• Should never be followed without applying your own professional judgment and broker guidance
• Does not guarantee any negotiation outcome

You are the licensed professional and the final authority on every transaction. We are a productivity tool that supports — not replaces — your expertise.

6. Property Reports and Valuations

Property reports use data from Rentcast and public records. These are not appraisals and should not be presented to clients as such. Automated Valuation Models (AVMs) have known accuracy limitations. All property data should be verified with county records, MLS, and a licensed appraiser before use in any contractual or advisory context.

7. Subscriptions and Payments

• Subscriptions are billed monthly at the rate displayed at checkout.
• Payments are processed by Stripe. By subscribing, you authorize recurring monthly charges.
• Cancellations take effect at the end of the current billing period. Access continues until then.
• No refunds are issued for partial months or unused features.
• We reserve the right to modify pricing with 30 days' notice to active subscribers.

8. SMS Messaging Program

RealtyAssistAI offers optional SMS features for subscribers. By providing your phone number, you consent to receive automated messages related to the Service.

• Message frequency: Varies by account activity, typically 1–5 messages/month.
• Message and data rates may apply.
• To opt out: Reply STOP to any message.
• For help: Reply HELP or email [email protected].
• Carriers are not liable for delayed or undelivered messages.

9. Acceptable Use

You agree not to:

• Use the Service to violate any federal, state, or local law, including fair housing and anti-discrimination laws
• Share access credentials with unauthorized parties
• Attempt to reverse-engineer, scrape, copy, or replicate the Service or its AI models
• Present AI-generated content to clients as your own professional opinion without independent verification
• Use the Service to generate misleading, fraudulent, or deceptive content
• Use neighborhood data to engage in discriminatory steering or redlining
• Resell or sublicense access to the Service without written permission

10. Professional Responsibility

Your use of RealtyAssistAI does not alter, reduce, or replace your professional obligations as a licensed real estate agent. You remain solely responsible for:

• All advice given to clients
• All documents submitted in transactions
• All representations made about properties, neighborhoods, or market conditions
• Compliance with your state's licensing laws, ethics codes, and MLS rules
• Your fiduciary duties to clients

RealtyAssistAI is a productivity tool. It assists your work — it does not perform it. When in doubt, consult your broker, attorney, or state licensing authority.

11. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT (A) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, (B) AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR APPROPRIATE FOR ANY SPECIFIC USE, OR (C) ANY DATA PROVIDED IS CURRENT OR VERIFIED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GETBOTPACKS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DEALS, LOST COMMISSIONS, REPUTATIONAL HARM, OR DATA LOSS — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless GetBotPacks LLC and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law, including fair housing laws; (d) your use of AI-generated content in professional transactions; or (e) any third-party claim arising from your professional activities.

14. Intellectual Property

RealtyAssistAI, its AI models, prompts, methodology, and underlying technology are proprietary to GetBotPacks LLC. Content you generate using the Service is yours to use in your professional practice. You may not reproduce, copy, or imitate the Service, its tools, or its AI methodology for commercial purposes without written permission.

15. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, violate fair housing laws, engage in abusive use of the Service, or engage in conduct harmful to other users or the platform. You may cancel your subscription at any time. Termination does not entitle you to a refund.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the American Arbitration Association rules, on an individual basis — not as a class action. You waive any right to a jury trial. Small claims court actions are exempt from this arbitration requirement.

17. Changes to Terms

We may update these Terms at any time. We will provide 14 days' notice of material changes to active subscribers via email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. The most current version is always available at realtyassistai.com/terms.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GetBotPacks LLC regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in full effect.
